THESE TERMS OF USE DESCRIBE YOUR RIGHTS AND RESPONSIBILITIES WHEN USING CIVICNATION.ORG, ALLINCHALLENGE.ORG , CHANGE-COLLECTIVE.ORG, ITSONUS.ORG, WETHEACTION.ORG, WHENWEALLVOTE.ORG, AND ANY OTHER SITE, SITE-RELATED SERVICE, OR PLATFORM OWNED AND OPERATED BY CIVIC NATION (together, “civicnation.org”, “our Site(s)”, “the Site(s)”, ). PLEASE READ THEM CAREFULLY.

These Terms of Use (“Terms”, “Agreement”) do not apply to digital services that Civic Nation does not operate but has a presence, such as Civic Nation profiles and pages on social media platforms such as Facebook, Instagram, or LinkedIn.

Acceptance of Terms.

Civicnation.org, including all site-related content and services, is provided by Civic Nation (“Civic Nation”, “we”, “us”, “our”), a 501(c)(3) tax-exempt organization.

By using the Site, you agree to comply with the Terms set forth on this webpage.

Please note that we reserve the right to update or modify the Terms of Use without advance notice by posting a revised Terms of Use to this website. Visitors to the Site (“you”) can determine whether the Terms of Use has been modified since your last visit by checking the “Effective as of” legend posted at the top of the Agreement. About CIVIC NATION; Purpose of CIVIC NATION.

Civic Nation is a nonpartisan, tax-exempt organization organized under Section 501(c)(3) of the Internal Revenue Code of 1986 that uses organizing, engagement and public awareness to address some of our nation’s most pressing challenges.

As a tax-exempt organization, CIVIC NATION is prohibited from supporting attempts to influence the outcome of any election for public office.

1. Signing Up for Certain Site Features

Based on the information you supply, we may contact you via email or SMS text messaging. Any contests, polls or other features requiring you to sign up may be governed by specific rules, which we will post for your review. By signing up for a particular feature, you become subject the rules governing that feature.

Mobile Terms and Conditions

There is no fee from Civic Nation to receive text messages. Message and data rates may apply- this can be checked with your mobile service provider. Charges are billed and payable to your mobile service provider or deducted from your prepaid account. Consent is not a requirement for purchase.
Data obtained from you in connection with this SMS service may include your mobile phone number, your carrier’s name and the date, time and content of your messages. We may use this information to contact you and provide the services you request from us. Alerts sent via SMS may not be delivered if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless operator may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather. Wireless operators do not guarantee message delivery and will not be held liable for delayed or undelivered messages.
We will not be liable for any delays in the receipt of any SMS message as delivery is subject to effective transmission from your network operator.
By subscribing to Civic Nation mobile alerts, the user consents to receive automated text messages to help build a more inclusive and equitable America. Recurring messages. 2. Prohibited Uses

You agree that you will use this Site only for lawful purposes and in accordance with all applicable laws, rules, regulations, and these Terms at all times. The following is a non-exhaustive list of prohibited uses of this Site. You agree that you will not perform, facilitate, or engage in any of the following or related prohibited uses:

Impersonating or attempting to impersonate Civic Nation or its employees, representatives, or affiliates;
Misrepresenting your identity or affiliation with any person or entity;
Using or attempting to use the Site to engage in unauthorized advertising or promotional activities, including but not limited to spam, junk mail, chain mail or similar materials;
Engaging in any conduct that restricts or inhibits any person’s use or enjoyment of the Site, or which, as determined by Our sole discretion, may harm Us or the users of this Site or expose Us or others to liability of any kind;
Using or attempting to use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with another party’s use of the Site;
Using or attempting to use any automated mechanism, such as a robot, spider, scrape, or similar automated technology, process or means to access or use the Website for any purpose, including monitoring or copying any of the material on this Site;
Using or attempting to use any manual process or means to monitor or copy any material on this Site or for any other unauthorized purpose;
Using or attempting to use any device, software, means or routine that interferes with the proper functioning of the Site, including but not limited to viruses, Trojan horses, worms, logic bombs or other such materials;
Attempting to gain unauthorized access to, interfering with, damaging or disrupting any parts of the Site, the server(s) on which the Site is stored, or any server, computer, database or other such system connected to the Site;
Attempting to attack or attacking the Site via a denial-of-service attack or a distributed denial of service attack;

Any other activities that, in Civic Nation’s sole judgment, may be objectionable, abusive, or contrary to these Terms.

Notwithstanding any terms and conditions described, Civic Nation reserves the right to terminate your license and permission to use our Sites, and block or prevent your access to and use of our websites without notice and according to our sole discretion.

3. Intellectual Property Rights and Re-Use Policy

You acknowledge and agree that all content and other materials on the Site, including without limitation, Civic Nation trademarks, and all designs, text, graphics, pictures, information, data, software, tools, widgets, sound files, other files and the selection and arrangement thereof (collectively, the “Site Materials”) will remain the proprietary property of Civic Nation or its licensors, providers, or users and are protected by U.S. and international intellectual property laws, rules, and regulations.

The materials produced on or published by the Site (including photographs, graphics, video and audio content) are protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries. All individual articles, content and other elements comprising this compilation and produced on or published by the Site are also copyrighted works. You agree to abide by all additional copyright notices or restrictions contained in any materials produced on or published by the Site.

All logos and slogans contained in the Site are trademarks of Civic Nation, its suppliers or licensors, or other third parties and may not be copied, imitated or used, in whole or in part, without the prior written permission of Civic Nation or the applicable trademark holder. You may not use any metatags or any other “hidden text” utilizing “Civic Nation” or any other name, trademark or product or service name of Civic Nation without our prior written permission. In addition, the look and feel of the Site, including all page headers, custom graphics, button icons and scripts, is the service mark, trademark and/or trade dress of Civic Nation and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned in the Sites are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, and supplier or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by us.

This license is revocable at any time.

We may make third party information and other content available on or through the Site (the “Third Party Content”) as a service to those interested in this information and we may provide information regarding or access to third party products or services available on or through the Site (“Third Party Products and Services”). Your business dealings or correspondence with such third parties, and any terms, conditions, warranties or representations associated therewith, are solely between you and such third party. Civic Nation does not control, endorse or adopt any Third Party Content or Third Party Products, and makes no representation or warranties of any kind regarding the Third Party Content, including without limitation regarding its accuracy or completeness. You acknowledge and agree that Civic Nation is not responsible or liable in any manner for any Third Party Content and undertakes no responsibility to update or review any Third Party Content. Civic Nation makes no claim or representation regarding, and accepts no responsibility for, the quality, content, nature, or reliability of third-party Web sites accessible by hyperlink from the Site, or Web sites linking to the Site. Such sites are not under the control of Civic Nation and Civic Nation is not responsible for the contents of any linked site or any link contained in a linked site, or any review, changes or updates to such sites. Civic Nation provides these links to you only as a convenience, and the inclusion of any link does not imply affiliation, endorsement, or adoption by Civic Nation of any site or any information contained therein. Applicable Law and Venue. These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the District of Columbia applicable to agreements made and to be entirely performed within the District of Columbia, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the state and federal courts located in the District of Columbia, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF CIVIC NATION, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE OR THE SITE MATERIALS EXCEED ONE DOLLAR ($1). CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF LIMITATION OF CERTAIN DAMAGES. You agree to defend, indemnify, and hold harmless Civic Nation and our directors, officers, employees and consultants, from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees) and other expenses that arise out of or from A) your activities in connection with the Site; B) any violation of these Terms of Use by you; or C) any allegation that any Submissions or other materials you submit to us or transmit to the Site infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party.
2. Severability If any provision of these Terms of Use is found to be unlawful, void or for any reason unenforceable, then that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of any remaining provisions.
3. Assignment. CIVIC NATION may assign its rights and obligations under these Terms of Use. These, together with all policies referred to herein, is the entire agreement between us relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements between us with respect to such subject matter.
